Summary:

  • The Socialist Party (PS) is seeking a preventive review by the Constitutional Court on new nationality rules.

  • The court must decide within 25 days after the request is submitted to Palácio Ratton.

  • At least 46 parliamentary signatures are required, with PS acting alone without other opposing parties.

  • Recent amendments may have reduced the controversy over nationality loss, particularly concerning President Marcelo.

The parliamentary group of the Socialist Party (PS) is set to request a preventive review by the Constitutional Court (TC) of the new rules for obtaining and losing Portuguese nationality, which are currently under consideration by the President of the Republic. According to sources from PÚBLICO, the PS is preparing the formal request to be submitted to the Palácio Ratton, where the court must issue a ruling within 25 days.

Deputies from the PS have already been briefed on the necessary procedures, including obtaining signatures, as the petition requires at least 46 subscribers. Notably, other parties that also voted against the legislation—such as Livre, PCP, Bloco, and PAN—are not being invited to join this initiative, highlighting the PS's independent stance.

The new nationality law has sparked debate, with recent amendments potentially making the loss of nationality less contentious for President Marcelo Rebelo de Sousa. This move by the PS underscores ongoing political friction over immigration and citizenship policies in Portugal.
