The Constitutional Court is set to announce its decision today at 5 PM regarding the parliamentary decree that modifies the legal framework for the entry, stay, exit, and removal of foreigners from national territory.
In a press release, the Court's External Relations Office stated that the announcement will be made during a press conference in the Public Acts Room of the Palácio Ratton, the Court's headquarters in Lisbon.
This decision follows a request by the President of the Republic for a preventive review of the decree's constitutionality on July 24, urging the Court to rule "urgently" within a maximum of 15 days, which ends today.
The decree was approved on July 16 in the Assembly of the Republic, with votes in favor from PSD, Chega, and CDS-PP, abstention from IL, and votes against from PS, Livre, PCP, BE, PAN, and JPP.
Criticism of the decree has been widespread among most parties, except PSD, Chega, and CDS-PP, with many deeming it unconstitutional and criticizing the legislative process for not consulting immigrant associations or constitutional experts and for lacking mandatory opinions.
In his request to the Court, President Marcelo Rebelo de Sousa sought a preventive review of the constitutionality of norms regarding the right to family reunification and its conditions, the deadline for processing applications by the Agency for Integration, Migration, and Asylum (AIMA), and the right to appeal.
